Legal Guarantee

What is it?

Liability for factual defects

Sellers of products are obliged to guarantee to consumers that products are in conformity with the relevant contract of sale for a period of two years after the delivery of the product.
Therefore if you are a consumer (according to the Consumer Protection Act, Official Gazette No. 20/98 , as amended), and your product has a factual defect (i.e. (i) if the product does not possess the properties necessary for normal use, (ii) if the product does not possess the properties necessary for personal use for which purpose you are purchasing it, and of which the seller was aware or should have been aware of, (iii) if the product lacks the properties or features which were expressly or implicitly agreed upon, or respectively prescribed, (iv) if the seller delivers a product which does not correspond to a sample or model, unless the sample or model was shown only for informative purposes) which existed at the time of delivery and that defect becomes apparent within two years from the delivery of the product, you are entitled to ask for:
  1. the removal of the defect from the product, or
  2. the partial refund of the amount paid for the product in proportion to the defect, or
  3. the exchange of the defective product with a faultless one, or
  4. the total refund of the amount paid.
You may exercise the rights above against the seller from whom you purchased your product.
You are entitled to demand your rights on the basis of a factual defect if you notify the seller about the defect within two months from the day on which the defect was noticed.
Unless proved otherwise, any lack of conformity which becomes apparent within six months from delivery of the product shall be presumed to have existed at the time of delivery unless this presumption is incompatible with the nature of the product or the nature of the lack of conformity.

Guarantee

You are entitled to first ask for the removal of the defect from the product if the product does not work faultless, or does not have the essential properties stated in the guarantee statement or associated advertising. If the defect is not repaired within a maximum period of 45 days from the date that the producer, seller or authorized service received the demand for the repair of the defect on the product, you are entitled to request a replacement of that product with a new, identical and faultless product free of charge. If the defect is not repaired or if the product is not replaced within the period of 45 days, you may ask for an appropriate reduction to be made to the price or for the contract to be rescinded. You may exercise these rights within the guarantee period (minimum of 1 year for IT products).
You may exercise the rights above against the guarantor or the seller from whom you have purchased your product.

What is the difference between Legal Guarantee and Commercial Guarantee?

The concept of Commercial Guarantee, such as HP’s warranty, is a guarantee voluntarily provided by the guarantor (either a seller or producer). The Commercial Guarantee may have a different duration and coverage than the Legal Guarantee, and typically (as in the case of HP’s warranty) it does not require you to prove the defect existed at the time of delivery.
The commercial guarantee does not replace or limit your consumer’s rights under the legal guarantee.
Consequently, the HP Limited Warranty provided with your HP product is independent, complementary to and does not affect in any way the Legal Guarantee, which you are entitled to and receive from the seller based on your purchase agreement of your HP product.
